A big thankyou to the prick who decided to cycle off the pavement right in front of my van.
You absolute .......... However you are not maimed and can still walk! I am thankful for that. I am a little upset tho that I need a new bonnet, bumper, 2 x grills, numberplate and a load of hassle, lost time crap hire vehicle ect. Well done to the emergency services arrived within 4 mins, lucky really( for his sake) when I saw the damage to my van after phoning them. As he is uninsured and classed as a pedestrian my Legal cover is worthless, will remember that next renewal !

That's bad luck! I had a guy on a motorbike go into the back of mine a couple of weeks ago and all he did was put a scratch on the bumper.

I must be a grown up now, having 4 kids does strange things to your mind.
I was more concerned for the boy (21years old) The way the law works I understand :- If I intentionally scrape your car with a screwdriver I am guilty, and will be charged accordingly through the courts and pay a fine. If I ride my bike onto a main road from a pavement into a very nice vehicle, the owner of the very nice vehicle bends over, gets shafted pays his excess. Simple.

I know only too well that sometimes the law just doesn't add up but that definitely seems very wrong - I find it hard to believe that someone can cause an accident which results in damage and no liability is attached.....? Worth double checking surely? I know that even if you can try to recover some of the costs there are a million other variables that come into play: Witnesses (or lack of) Possible lack of cash to reimburse you (in the event that the decision does go your way) Potential legal costs for you and possibly none for the other party (depending on their "status") I aint trying to discourage you but you get the idea........ |

+1 on that! A wise barrister once shared a quiet moment outside court with me many moons ago & said one should never go into court on a principle but always base it on the costs. Pride can be lived with, costs stay forever. Try writing a nice letter or a visit, use personality maybe? Or punch the twat..

Most house owners have household insurance and believe it or not covers them for being a twat when they are out and about.
I was unfortunate to kill a lad many years ago, he stepped out in front of me from behind a van whilst having a drunken argument with his girl friend....... long story short, it ruined the car and I didnt have gap insurance as I could barely afford the finance as it was.
So with the help of my fathers friend we were able to sue the lads parents insurance company for loss of earnings and the loss of the vehicle including the gap on the finance, I felt terrible having to do it, had it have been a few hundred quid I would've let it slide but it was 3K (circa 1986)
There will be some form of recourse, even if you have to take him to small claims court to recover your excess, if he doesnt pay within 28 days they send the bailiffs in..

There's definitely routes for recovering costs if you so wished - but would be totally up to you if you chose to do so. IMO you should be applauded for (appearing to be) so mellow about this considering you're entirely fault-free yet it's costing you...
I cycle to work daily and for that reason I've got 3rd party liability insurance via the CTC (Cyclist's Touring Club - British Cycling also offer this). It costs ~£60/yr for joint membership with my wife but it's worth it for piece of mind (has other benefits of legal assistance should I need it). Basically if I f**k up and accidentally caused damage to a vehicle, there's cover for the repairs to theirs, etc. I only cycle on the roads for getting to/from work, but I know many road cyclists who do it for "fun". Most of them have 3rd party cover too. Luckily a mate who rear-ended a 2-month old Bentley at a mini-roundabout (wet road, crap brakes) had cover as the repair cost was sizeable the driver was unsurprisingly massively p*ssed off... |

Its true hes fucked, in fact he may even get done, the law states that you allways have to account for idiots on the road at all times, and should allways be able to stop and avoid a accident, the only reason i say this as it happened to me..im not sure the above is the technical term..
My Story which is still on going.. im riding my motorbike with a mate behind me we are on our way to tescos.. i come off a roundabout start to accelerate, the next thing i remember is waking up with my motorbike on top of me jaw broke in 3 places (titanium plates fitted) ground my wrist to the bone and needed plastic surgery and tendons pinned back, broken leg (T shape Fracture) and ligimant damage, and damage to my neck (spine) whiplash which is so bad i have to wear a scarf in winter because my neck siezes up.. turn out a guy had parked his car on a brow of a hill on a blind bend, he didnt even pull over, so his car was blocking one lane, in the meantime hes stepping back from his car and is standing in the other lane, i hit him knock myself out, and we both end up in hospital for awhile,hes in a bad way, broke his scull legs arms pelvis. police interview me nothing said, nearly 9 months later i get a letter from police driving without due car and attention, they offer me a driver awarness course, or i go to court and risk getting a big fine and a ban, i risk everything and go to court, where im found not guilty (£3500 solicitors fees) which i claimed back from courts, im now awaiting a court date to find out who the insurance are going to pay... to cut a long story short the copper i dealt with was shocking, the worst ever and he lied on numerous occasions, but as he was out of his car he was a pedestrian and they sided with him, even though as a car driver he had a duty of care and safety of road users.. so i wouldnt be suprised is you get something through the door..

unfortunately we have turned into a claim culture , I feel very fortunate having done loads of mad things and never broke a bone or been ill and am nearly fifty

Now you know why my vans have front and rear facing camera 24 seven for twats like that. I had a twat come flying down the hill from the Stranmillis Road on the foot path and start flying across the zebra and when he realised I was not stopping hit the anchors and went flying over the handle bars. Front wheel abit square, forks bent and he never actually touched my vehicle, the rear cam got a lovely face plant on the road as I went onto the round about proving he never actually collided with my van. He called plod, plod came and was all going to be my fault till the video was played. "Officer is it not an offence to cycle on the foot path at that speed?" "Officer he is a road user on a cycle, on the foot path riding like a mad man negoiting a round about on the foot path and crossing and I should have stopped, No!" Plod looked at the video again and when back and told him,"If you want the bike fixed sue him, hes got a video of you riding like a mad mad, don't you will stand much of a chance!" Got a small claims summons, I counter claimed for my time attending, when and seen the mageristrate who watched the video and awarded me my counter claim,"If you ride like that, you deserve a ticket!" You wonder why van drivers hate crazy cyclists with a passion. We had a pole not from from home try to play chicken with a 4 axle quarry lorry, sorry for the driver as he squahed her like a tomato, the taxi bloke behind told plod she clipped his wing mirror under taking him as the lorry was indicating to turn left at the lights. Splat! The real pain was the main road closed for six hours! ![]() Won't play chicken again! A mate brother when I was young, back in 82 shot out of his drive and hit a car, his Dad had to stump up for the damage to the motor back then. Take the arsehole. The camera never lies!!!!

Alonline - I am sure it has been asked before but where did you get these cameras from and what is the costs of installing them?
I guess they are powered by the cigarette lighter? I seem to remember it was covered here before but I can't find it on the search... Thanks.

The cameras cost about £300 a vehicle which has paid for themselves several times over.
I would need to look up where I got them. The first place I got them went belly up but the manfacturer gave me another contact and I ordered my last one. It is a small recorder recording onto a memory card which has a G sensor and a button which enable you to freeze the previous 5 minutes which can only be deleted by putting the card into a PC. The system uses GPS to locate the vehicle and can give average speed. I fitted the last system myself because I was looking for a perm live under the bonnet/dash in a previous inquiry but found one which has not burnt the van out yet The rear camera came from E-bayas the one in set is design to be inside a rear window but I use a number plate camera. Nothing like a good movie to show who is lying!! You also don't have to declare the cameras, instead let things progress and if they don't look like going well and the liars have signed their statements then pull out the ace card. It is always a knock out blow.

Pretty pricey then! I guess you leave it running when the vehicle is parked too so if anyone does anything to it then you can hunt them down. It is pretty sad that we have to consider options like this just for self protection. I've got a gopro camera I use, so I might just mount that for the time being but you can't have it so it loops and records over old footage which is a shame. Bloody society eh!!

after my road rage 'incident' last year I fitted a blackvue dr350.
bit cheaper now, but this one I paid £160ish.... and if I'd had it in the van then, it would have saved more than that already.... and it would not have caught any of the incident itself (he crashed into the side of me) but he stopped me twice and got out of his car, and denied it.... this would have been on camera, and as said would be enough to prove he was lying. I hit a deer on monday, only just... knocked the fog grille off and the deer ran off.... but it's all on camera.... police are refusing to prosecute the deer too... |
